BUNMI JENYO HAILS COURT OVER JUDGEMENT ON EXAMINATION FRAUD AGAINST ADELEKE’S CO-ACCUSED

A former South West Zonal Secretary from the Central Senatorial District of Osun State, Rev. Bunmi Jenyo has lauded the judiciary for clearing the air on the charges of examination malpractice against the co-accused of the PDP 2018 Governorship Candidate, Sen. Ademola Adeleke.

This was cobtained in an exclusive chat with Nigerian Platform on Wednesday, after the charges had been struck out before a Federal High Court, Abuja.

Justice Inyang Eden Ekwo had discharged and acquitted the four persons accused alongside Sen. Adeleke of committing the alleged examination malpractice in the last Governorship Election in the State.

Rev. Jenyo who stated that the case ab initio, was just a vituperation of some aggrieved individuals, said the truth always remain constant no matter the space of time for prevalence of lies.

He described the judgement as a true reflection of the fact that judiciary is the last hope of the common man and that the judgement is timely to lay off certain uncertainties concerning the credibility of Sen. Adeleke to lead.

He thereafter charged all PDP members in Osun State to join hands and rescue people from the ruins and sufferings occasioned by the ruling of the All Progressives Congress (APC).

He also appreciated the judiciary for setting the records straight and congratulated Sen. Adeleke, his co-accused and all PDP members for the legal victory.

Appeal Court dismisses Olujimi’s suit against Ekiti PDP …No Victor, no vanquished, says Fayose

APPEAL COURT DISMISSES OLUJIMI CAUCUS SUIT OVER EKITI PDP CONGRESSES … NO VICTOR, NO VANQUISHED – FAYOSE

The Appeal Court sitting in Ado EkitI, today, dismissed the suit filed by the caucus loyal to the Senator representing Ekiti South senatorial district, Biodun Olujimi over the congress that produced the present Ward Executive Committee members of the Peoples Democratic party (PDP) in Ekiti State.

Delivering judgment in the Appeal Number CA/EK/57/2020, the Appeal court upheld the decision of the trial Court and ressolved all issues against the Appeallant, Oladimeji Samson Olalekan.Olujimi, had through Oladimeji Samson Olalekan and others, filed a motion ex-parte, seeking an order of the court, restraining the PDP National Working Committee (NWC) from announcing, publishing, and recognizing any list as result of election of Ward Executives and three ad-hoc delegates held on March 7, 2020, as well as an order restraining the party from acting on, or making use of the names of winners of the Congresses for the purpose of the Local Government, State and Zonal Congresses.

Justice Uche N. Agomoh of the Federal High Court sitting in Ado Ekiti had on Friday, July 17, 2020 dismissed the suit, describing it as undoubtedly not justiceable as same is within an internal affairs of the PDP, citing UKUT vs. APC.

The court also awarded N200,000 cost against the plaintiff and their Counsel to be paid to the PDP, the 4th and 5th defendants on or before of September 1, 2020.In upholding the lower court decision today, Justice T.N Orji-Abadua said the appellant’s case was not justifiable since it was centred on internal affairs of a political Party.

Reacting to the judgment, Fayose said “To all PDP members, please see this a victory for all. No victor, no vanquished. We are in deep talks to reconcile all. We should refrain from provocative languages.

“The National Working Committee (NWC) of the party had in a letter with ref no: PDP/DOM/GF.V/VOL.2/20-387B dated April 25, 2020 and signed by Col Austin Akobundu (rtd), National Organizing Secretary, ordered the state chairman of the party to inaugurate the 155 ward EXCO for the fourteen out of the sixteen local government areas of the State, where the remaining two local government areas contained 22 wards are yet to conduct their Congresses.

β€œAfter giving a careful consideration of the reports of the Electoral Committee and the Appeal Panel, has, on behalf of the National Executive Committee (NEC) of the party, approved the said Congresses and the Executive Committees emerging therefrom.

β€œYou are therefore by this correspondence, directed to take necessary and appropriate steps to Inaugurate the new Executive Officers in accordance with the provisions of Section 65 of our Party’s Constitution as amended in 2017” the letter stated.β€œIn doing this, you’re please advised to also take into proper account the provisions of the Nigeria Centre for Disease Control (NCDC) Guidelines of Covid-19 as it concerns Social Distancing and the gathering of people in one place.

β€œThis shall be the new Exco Members at the expiration of the current Executives, i.e. April 30, 2020 for Ward, and shall hold office for a period of four (4) years pursuant to Section 47(1) of our Party’s Constitution as amended; (i.e. April 30, 2020 – April 30, 2024 for ward Executives).β€œAccordingly, I hereby forward to you the authentic list of the Ward Executives for 155 out of the 177 wards of your State as contained in the attached lists of Names of Approved Ward Exco Members,” the statement added. But the caucus loyal to Senator Biodun Olujimi today, suffered a major setback in its bid to grab the control of the party in the state, with the Appeal Court, dismissing its case challenging the inauguration of the Ward Executive Committee members of the party elected at the March 7, 2020 Ward Congresses in the state.

Court discharges, acquits examination fraud charges against Sen. Adeleke’s co-accused

COURT DISCHARGES, ACQUITS EXAM FRAUD CHARGES AGAINST SENATOR ADELEKE’S CO-ACCUSED.

From Kayode Lawal Abuja

A. Federal High Court in Abuja, on Tuesday dismissed the examination fraud charges brought against a Secondary School Principal Alhaji Aregbesola Mufutau and three others who were put on trial along with Senator Nurudeen Ademola Adeleke by Police.

Justice Inyang Eden Ekwo discharged and acquitted the four persons accused of committing the alleged examination malpractices alongside former Peoples Democratic Party (PDP) governorship candidate in the last election in Osun State.

The Judge freed the defendants from the seven amended count charge while delivering ruling in their no-case submission.

The Police had in 2018 arraigned Adeleke along with Sikiru Adeleke (who is said to be the Senator’s relative), Alhaji Aregbesola Mufutau (the school principal), Gbadamosi Thomas Ojo (a school registrar) and Dare Samuel Olutope (a teacher) on a four count charge bordering on examination fraud.

However, the court had last year freed Adeleke from the charges after it was withdrawn by police.

The police predicated their action on the grounds that Adeleke had failed to make himself available for trial since he was granted leave to travel abroad on medical grounds.

The police then prayed the court to sever the charge, to exclude Adeleke from the trial and arraigned the remaining four on a seven count charge bordering on conspiracy.

After calling five witnesses the police closed its case which led to the filing of a no-case submission by the defendant.

In his ruling on the no-case submission, Justice Ekwo held that the prosecution failed to establish prima facie case having not proved the ingredients of the charge.

Ekwo further held that the burden of prove rested on the police which according to him failed woefully in discharging the burden by not calling relevant witnesses.

“No witness was called from the National Examination Council (NECO) to testify throughout the trial. To worsen the situation, no eye witness was called from the school on the day the alleged malpractices were perpetrated”, Ekwo held.

Besides, the Judge said that there was no iota of the ingredients of conspiracy supplied to the court by the police to establish that the four defendants conspired to commit the alleged malpractices.

“In all, the evidence of the five witnesses were so discredited during cross examination and so manifestly unreliable to warrant the defendants to be called upon to enter their defense in the charges against them.

“In conclusion, since the testimony of the prosecution is insufficient to warrant the defendants to open defense, I have no difficulty in upholding their no-case submission and discharge and acquit them from the charges. This charge is hereby dismissed”, the judge held.
